"I Want to be your Boyfriend" is The Rubinoos song you’re referring to.
They sued Avril Lavigne and/or her record company, but it was settled out of court… probably because it would be more expensive in time and money for Avril’s team to win the lawsuit in a lengthy court case.
A "Video" on Youtube is linked below with the studio (clean) version of this song, and doing a search on Youtube for the band will show some links to live performances.
I also added a link to an Avril Lavigne fan site’s article about the lawsuit from start to finish, including a list of other famous songs that share a similar sound or chorus as the Rubinoos’ song chorus – including some that came out BEFORE that Rubinoos song.

I think this is Hollywood/Producers at work…
It is what gets young gals to listen and pertains to their lives… Clothes, video, weight, who is dating who at the time, all play a factor…
Are they the same… yes.. will there be more of the same in the future… yes… why, romeo and juliet is as old as time and so will be the repeat of the message of love and longing in young girl videos…
I think it is cool. 
Yeah I agree with Mari C, She was like doing alot of punk rock music & then she just come out with this pop song, I really did used to like Avril I was a huge fan but I was really disappointed when she brought out that song & when their was a remix version with Lil Mama that was even worst. The song was just overplayed & was so annoying! She should just go back to her old style.
